Regulamin reklamacji

Principles for Śnieżka Trade of Colours Sp. z o.o. assisting customers with complaints for products purchased from a seller other than entities part of the ŚNIEŻKA group of companies.

1. If the buyer purchases a product directly from a seller other than an entity part of the ŚNIEŻKA group of companies (Fabryka Farb i Lakierów "Śnieżka" S.A., Radomska Fabryka Farb i Lakierów S.A., Śnieżka Trade of Colours Sp. z o.o.) then implied warranty complaints should be submitted to that seller (their details are on the invoice, bill or receipt).

2. This document sets out the principles for support provided by Śnieżka Trade of Colours Sp. z o.o. with its registered office in Warsaw (code: 00-867) at ul. Chłodna 51, NIP: 8722387389, REGON 180632944, registered in the Commercial Register of the National Court Register under KRS number: 0000373430, share capital of PLN 303,558,000.00, BDO number: 000499445, (hereinafter referred to as the "Company") for customers who purchased products manufactured by Fabryka Farb i Lakierów "Śnieżka" S.A. (all product brands) or Radomska Fabryka Farb i Lakierów S.A. (all product brands) at a seller other than Fabryka Farb i Lakierów "Śnieżka" S.A. (up until 31.12.2020) or Śnieżka Trade of Colours Sp. z o.o. (after 01.01.2021). The Company is not authorised by other sellers to accept implied warranty complaints – nevertheless, in the cases specified in this document, if a defective product is reported, the Company will endeavour, as far as possible, to assist the customer as specified in this document.

3. This document does not replace or change the implied warranty or guarantee complaints set out in the Dekoratorium.pl shop Terms and Conditions or in the relevant guarantee terms and conditions.

4. This document shall not be applicable if the entity responsible for the implied warranty or guarantee is part of the ŚNIEŻKA group of companies (Fabryka Farb i Lakierów "Śnieżka" S.A., Radomska Fabryka Farb i Lakierów S.A., Śnieżka Trade of Colours Sp. z o.o.). and the product was covered by the manufacturer's guarantee or the product was purchased directly from any of the above entities.

5. The assistance provided by the Company shall only be available to customers who reside or have their registered office in the territory of the Republic of Poland.

6. A customer who has purchased products manufactured by Fabryka Farb i Lakierów "Śnieżka" S.A. or Radomska Fabryka Farb i Lakierów S.A. and at the same time:

  1. the product is defective or the product does not conform with the agreement,
  2. the product was not covered by the manufacturer's guarantee,
  3. the product was purchased from a third party who should have performed the seller's implied warranty obligations at the time of sale,

may seek the Company's assistance in obtaining legal protection for implied warranty claims from another seller. The Company shall, as far as possible, take steps to resolve the customer's problem.

7. The assistance referred to in item 2 may consist of the following actions:

a) Assistance in investigating the validity of the complaint (this does not include making an implied warranty claim to the relevant seller),

b) Replacement of the product subject to the complaint with a new one free of defects by the Company.

8. A refund of the sale price paid by the customer, a defective product report with a request for assistance should be sent in the following method:

a) via the Dekoratorium shop Account using the complaint form located there. See the Dekoratorium.pl shop Terms and Conditions for Account use terms.

9. The report referred to in item 8 via available communication channels shall not be tantamount to a declaration regarding the performance of implied warranty obligations and shall not replace such a declaration. Such a report is not a complaint pursuant to Art. 556 et seq. of the Civil Code, or a complaint pursuant to the provisions of Art. 43a et seq. of the Consumer Rights Act.

10. Only the information concerning the defect or non-conformity of the goods with the agreement shall be the subject of the Company processing the report with a view to possible assistance.

11. Only the customer who is the purchaser of the product may submit such a report.

12. If the report is incomplete but may be remedied (e.g., it does not contain all the necessary information, the application is not accompanied by a scan of the proof of purchase) and the customer has provided contact details, the Company will contact the customer to remedy report deficiencies. If the report is not completed within 14 working days of receipt of the request, the report will be left unprocessed.

13. If required the Company may ask the customer to provide additional information if this is necessary to process the report.

14. The Company shall, within 21 days of sending a correctly completed report, inform the customer of the results of carried out processing of the report and indicate the manner of assistance set out in item 7 or will refuse to provide assistance, stating the reasons for the refusal.

15. The company provides assistance to the customers free of charge.

16. If a customer purchased the product directly from the Company, reporting the complaint via Dekoratorium.pl shop has the effect of making a declaration on the exercise of implied warranty and/or guarantee rights. Subject to such customer's rights, the Company's obligations and the manner of proceeding shall result from the Dekoratorium.pl Internet Shop Terms and Conditions, legal regulations and/or guarantee terms for the given product. If a customer purchased the product directly from the seller other than the Company, and the product in question is covered by a manufacturer’s guarantee (Fabryka Farb i Lakierów "Śnieżka" S.A. or Radomska Fabryka Farb i Lakierów S.A.), reporting the complaint via Dekoratorium.pl shop has the effect of making a declaration on the exercise of implied warranty and/or guarantee rights. Subject to such customer's rights, the manufacturer’s obligations and the manner of proceeding shall result from legal regulations and guarantee terms.

For what purpose and on what basis do we process your personal data?

Your personal data shall be processes with the purpose of processing the report you submitted to Śnieżka Trade of Colours. The legal basis for processing your personal data constitutes Article 6 paragraph 1f) of the GDPR, where legitimate interest entails processing your report and providing the required assistance. Provision of data is not compulsory but necessary to process your report.

Śnieżka Trade of Colours will provide your personal data to other recipients who have been entrusted with the processing of personal data on behalf and for the benefit of Śnieżka Trade of Colours, including Fabryka Farb i Lakierów "ŚNIEŻKA" S.A. with its registered office in Warsaw, ul. Chłodna 51, 00-867 Warsaw (registered in the Register of Entrepreneurs of the National Court Register under KRS number: 0000060537, NIP: 8181433438), if this is necessary for the performance of activities related to the processing of the report and providing the necessary assistance. In addition, Śnieżka Trade of Colours will share your personal data with other recipients, insofar as this is required by law.

Your data shall not be transferred to third countries or international organisations.

How long will we process your data for?

We shall process your data for a period during which your report is processed and also for archiving purposes – however for no longer than 5 years from the end of the calendar year in which your report was processed.

What are your rights?

You have the right to:

  • access your personal data and receive a copy of the personal data subject to processing;
  • rectify your inaccurate data;
  • erase data (‘right to be forgotten’) subject to circumstances as prescribed in Article 17 of GDPR;
  • demand a restriction of data processing in circumstances as prescribed in Article 18 of GDPR;
  • object to data processing in circumstances as prescribed in Article 21 of GDPR;
  • portability of data processed in an automated manner.

If you consider your personal data are processed illegally, you have the right to submit a complaint to a supervisory authority (President of the Data Protection Office, ul. Stawki 2, Warsaw).

18. The present principles may be amended at any time. At the same time, the Company reserves the right to terminate the assistance programme set out in this document at any time.

19. Any matters which have not been regulated herein shall be governed by the Polish Law and in particular the provisions of the Civil Code.

20. The present document does not exclude, limit or suspend the buyer's rights stemming from statutory implied warranty provisions for inherent defects, consumer warranty in the event the goods are do not conform with the agreement, and also guarantee (if such was granted in relation to the given product).

21. The present terms shall be effective as of 01.01.2023.
